Check Your Lease and Plan for Action

I advised a Local Authority tenant moving out of 500m² of offices. The landlord threatened them with a claim for damages approaching £50,000 for repairs and decorations, with a further claim for loss of rent and fees likely to increase this to £75,000. When I checked the lease carefully, it was obvious that the claim was excessive.

As is often the case, there was little time to negotiate or carry out repairs. I advised the client to get on with the work in case negotiations failed, and in the end employed contractors on the client's behalf. The contractor carried out £15,000 of work and my client handed the office back to the landlord on the due date.

Naturally, the client was happy, but in this case so was the landlord - they had an office ready to let from day 1 without the hassle of clearing up and decorating.
